Permits, projects and investment: key considerations under the new administrative control regime

As of June 1, 2026, the new regime introduced by Resolution No. 3 of the Chilean Comptroller General’s Office came into force, applying to administrative acts issued from that date onward. While it may appear technical, this change has significant implications for companies and projects that depend on permits, concessions, authorizations, and regulatory milestones.

The way these acts are processed and subject to legal review can directly affect project development, particularly in terms of timelines, documentation requirements, and regulatory strategy.

In this context, companies should focus on three key dimensions. First, timing, as project schedules may require adjustments and a more detailed understanding of administrative procedures. Second, documentation, where the quality, consistency, and legal robustness of filings become increasingly critical. Third, strategy, which evolves from a procedural aspect into a core element of risk assessment and project due diligence.

The updated regime also reinforces the need to prioritize legal control over the most relevant administrative acts, highlighting the importance of anticipating regulatory contingencies and reviewing internal processes.

In highly regulated projects, administrative processes are not merely formalities—they are key execution factors. Reviewing ongoing permits, regulatory milestones, coordination between legal, technical, and business teams, and potential timing contingencies is essential to ensure project certainty.

Understanding these changes early can make a meaningful difference in industries such as energy, infrastructure, and other permit-intensive sectors.
