Foreign Investment in Chile: How to Implement Investment Screening without Hindering Growth

Raquel Frattini, international lawyer and business development director at Chirgwin, recently published an opinion column in EstadoDiario addressing one of the most relevant regulatory debates for the future of foreign investment in Chile: the introduction of investment screening mechanisms to assess investments impacting strategic sectors, without undermining the country’s economic openness or legal certainty.

Drawing on the so-called Chinese Cable case, the author analyzes how the absence of clear rules and preventive review mechanisms can lead to regulatory uncertainty, diplomatic friction, and negative signals to the market—particularly in a context marked by geopolitical tensions and increasing competition among global powers.

The column argues that the key question is not whether Chile should move forward with investment screening tools, but how to design them in an institutional, forward-looking manner that is compatible with economic growth, making use of the existing legal framework for foreign investment. The analysis also includes comparative references and emphasizes the importance of avoiding improvised regulatory responses that could undermine system predictability.
